Aggrieved by the order dated 27.08.2020 passed by the learned Single Judge in dismissing Writ Petition (M/S) No. 3864 of 2018, the petitioner has filed this appeal.
Learned counsel for the appellant contends that the learned Single Judge committed an error in dismissing the writ petition; and what he, sought for, was a just and fair inquiry, which has not been done. Hence, he pleads that the appeal be allowed by allowing his writ petition.
On hearing learned counsels, we do not find any merit in this appeal. The plea of the petitioner was countered by the learned additional chief standing counsel in his submission that the only irregularity found during the inquiry was that the measurement book was not countersigned by the executive engineer/assistant engineer, but it was signed only by the assistant engineer. On the direction of the district development officer, block development officer, Kanpur submitted his report that the irregularity has since been removed. On this ground, the petition was dismissed.
We do not find any ground to interfere in the well-considered order passed by the learned Single Judge. Out of the two counter signatures that are required, one was missing, that cannot be said to be an illegality. At the most, it can be an irregularity, which also has been rectified. Even otherwise, the Lokpal, MGNREGA has acted upon the complaint.
Under these circumstances, we do not find any ground to allow this appeal. The same is dismissed.
Pending application (CLMA No. 7625 of 2020) also stands rejected.
