Prafulla C. Pant, J.—This is Application No. 1411 of 2010, moved on behalf of the Appellant seeking to withdraw the appeal.

The Application is supported by affidavit of Prem Datt Bhatt (Appellant/complainant). Appellant has filed the appeal against the judgment and order dated 1.8.2002 passed by Civil Judge (Junior Division) Rishikesh, in Criminal Case No. 196 of 1985, whereby said court has acquitted the accused/Respondents Mulayam Singh (son of Kundan Singh), Surendra Singh (son of unknown), Smt Kedari Devi, Kumari Sushila and Smt Roshni, from the charge of offences punishable u/s 147, 453, 323/149,325/149 I.P.C.

Learned Counsel for the parties stated that the complainant/Appellant has already entered into compromise relating to property on account of which alleged " MARPEET " is said to have been taken place. Learned Counsel for the Appellant in the circumstances further stated that he does not want to press the appeal.

The Application No. 1411 of 2010 is allowed. Appeal stands dismissed as not pressed.
