Heard.
Complaint filed by the complainant was allowed by the District Forum on the premise that the respondent Bank could not raise any demand towards any outstanding loan which the complainant had obtained for purchase of the vehicle, since the Bank had itself issued the no objection certificate (NOC) in his favour to that affect.
Learned State Commission, however set aside the decision of the District Forum after noting that NOC was not issued by the Bank but its authorised signatory, through whom the vehicle had been purchased and who was attached to the concerned collection agency. Learned counsel for the respondent has drawn attention to the cross examination of the complainant, the said person who had issued the purported NOC (Annexure A 6) namely Mr Vijay Gahlawat in which he had admitted that actually only the employees of the Bank were competent to issue the NOC and the collection agent was not competent to do so.
This factual position is uncontroverted from the available material on record. Therefore, this Commission find no grounds to interfere with the well-reasoned decision of the State Commission accordingly, the revision petition is dismissed. Parties to bear their own cost.
