This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with Sunabeda P.S. Case No. 209 of 2019 corresponding to T.R. Case No. 52 of 2019 pending in the Court of learned Addl. Sessions Judge -cum- Special Judge, Koraput for offence punishable under section 20(b)(ii)(C) of the N.D.P.S. Act.
Learned counsel for the State has filed the letter of the Superintendent of Police, Koraput dated 14.11.2022 from which it appears that the name and address given by the petitioner in the cause title of the bail application is found to be genuine. The letter is taken on record. Learned counsel for the petitioner submits that as
some of the co-accused persons have been released on bail and the petitioner is in judicial custody since 30.12.2019, the petitioner may be permitted to withdraw this bail application with a liberty to renew his prayer for bail in the Court below.
In view of such submission, this bail application stands disposed of with the liberty as aforesaid.
