The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 27.01.2026 whereby respondent-Council has cancelled his registration certificate.
As per petitioner, he passed 10+2 from Board of Higher Secondary Education, Delhi. He got admission in Diploma in Pharmacy (D. Pharm.) in Lord Krishna College of Pharmacy, Khokhar, District Sangrur. He passed D. Pharm. in June’ 2012. He applied to respondentCouncil for registration as Pharmacist. He was issued drugs licence dated 09.02.2016 under Drugs & Cosmetics Act, 1940. He applied for renewal and respondent called him to appear in the office of council on 02.12.2025. The respondent-Council has ordered to cancel his registration on the ground that there was irregularity in his 10+2 Certificate.
Learned counsel for respondent No.3 submits that as per Rule 104 of State Pharmacy Council Rules, 1951, the petitioner has remedy to approach Pharmacy Council against decision of Executive Committee.
Faced with this, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to approach Pharmacy Council seeking restoration of his registration.
Dismissed as withdrawn with aforesaid liberty.
It is made clear that if petitioner files application for restoration within two weeks from today, it shall be decided within two months on merits.
