Present writ petition is filed by the petitioner for indulgence of this Court for a direction to the respondent authority to consider the case of the petitioner for compounding/conversion from residential to commercial in accordance with law and till then the order dated 17.08.2024 may be kept in abeyance.
Heard learned counsel for the parties.
It is submitted by learned counsel for the petitioner that petitioner is the owner of the property situated in Kanwali Road, Dehradun within the jurisdiction of M.D.D.A/respondent. The petitioner candidly submits that property of the petitioner is residential one but the same is being used as commercial property, therefore, a show cause notice was issued by the respondent, M.D.D.A. on 17.08.2024 to the petitioner calling upon to show cause as to why the property be not sealed and demolished.
Since the order dated 17.08.2024 is merely a show cause notice, the petitioner can show the reasons to the competent authority why show cause notice be discharged and can get appropriate orders. Writ petition is not maintainable against a show cause notice.
Accordingly, the writ petition is not maintainable at this stage. The same is dismissed in-limine.
