This petition has been filed against rejection of candidature of the petitioner by respondent No.4 during selection and appointment process to the
post of Clerk by way of Limited Direct Recruitment in the Department of Irrigation and Public Health, Himachal Pradesh.
In reply to the petition, it has been specifically averred that for appearing in the typing test during selection and appointment process, petitioner was
required to have rendered five years regular service or regular service combined with continuous service rendered on daily wage or on contract basis
as per amendments made in Recruitment and Promotion Rules of Clerk notified by the Department of Personnel vide notification No.Per(AP-C)-
A(3)-2/80 dated 28th May, 2010, and in the present case, services of the petitioner have been regularized w.e.f. 18.02.2012, and as such he was not a
regular employee and was regularized on a date which is a date subsequent to the last date of submission of application i.e. 30.10.2011.
In view of clarification placed on record with the reply, I find no merit in the petition and accordingly the same is dismissed. Pending application(s),
if any, also stand disposed of.
