This matter is taken up physically in Court.
The writ petition is registered before this Court on 17.12.2021 after the Original Application was transferred upon abolition of the learned O.A.T., Cuttack Bench, Cuttack.
On perusal of the available order-sheets of the learned Tribunal, it is indicated that learned Tribunal was pleased to issue notices on 6.2.2015 and the matter was never taken up/pursued after 29.4.2015.
The O.A. was filed by a group of petitioners who were working as contractual para medical employees in the establishment of the opposite parties challenging the orders dated 6.12.2014 & dated 19.1.2015 (Annexures-5 & 6 respectively). By order dated 19.1.2015 (Annexure-6), the Director, Health Services, Odisha (O.P. No.3) directed that the Grade Pay drawn in favour of the contractual employees prior to the letter dated 6.12.2014 of the Finance Department was to be adjusted from their respective remunerations.
On perusal of the available order sheets of the learned Trbunal, it is indicated that on 6.2.2015 interim order was passed directing that no action shall be taken pursuant to order dated 19.1.2015 (Annexure-6) passed by the Director, Health Services, Odisha (OP No.3).
Learned Standing Counsel submits that copy of Original Application is not available.
Learned counsel for the petitioner shall serve photo copy of the entire pleadings on the learned Standing Counsel.
Learned Standing Counsel shall be at liberty to take copies of documents of the learned Tribunal on payment of usual cost from the Registry of this court. Learned Standing Counsel shall obtain up-to-date instruction regarding adjustment of Grade Pay as per Annexure-6.
