Judgment

The petitioner, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 r/w. Section 379 I.P.C., in Crime No.94 of 2024, seeks anticipatory bail.
The case of the prosecution is that the petitioner and other accused illegally transported one unit of river sand by using TATA 407 Van.
The learned counsel appearing for the petitioner submits that the petitioner is an innocent and he is in no way connected with the alleged offence.
The learned Government Advocate (Crl.Side) raised serious objection on the ground that the petitioner is having one previous case. The petitioner has used the vehicle without any registration number and registration number of the vehicle found was removed and therefore, the police suspect this vehicle might be a theft vehicle.
Considering the objections of the learned Government Advocate (Criminal Side) and considering the facts and circumstances of the case, interim anticipatory bail is granted to the petitioner enabling him to appear before the respondent Police for investigation. The petitioner shall appear before the respondent Police daily at 10.30 a.m. for a period of one week from 22.04.2024 onwards and co-operate for the investigation.
The respondent Police is directed to file a report as to the role of the petitioners in the offence on the next date of hearing. Post the matter on 26.04.2024. Till such time, the petitioner shall not be arrested.
