Judgment
Heard Mr. Priolkar, learned counsel for the Applicant. Mr. Omkar Thakur a/w Mr. Omkar Parab, for the Respondent No.1 and Mr. Nikhil Vaze, Additional Public Prosecutor for Respondent No.2.
This is an Application for condonation of delay of 54 days in preferring the present Criminal revision Application against the order of conviction.
Perusal of the Application indicates that, sufficient cause is made out in paragraphs 7, 8 and 10 of the application for condonation of delay. The reason for the delay as mentioned in the Application is that the Applicant was making efforts to settle the matter and that the delay has occurred due to certain misconception/misunderstanding. Learned counsel appearing for the Applicant, on instructions submits that, to show his bonafides the Applicant has already paid an amount of Rs. 33,000/- before filing the present application and an amount of Rs. 10,000/- is paid thereafter. As of today a total amount of Rs. 43,000/- has been paid to the Respondent No.1 and the balance amount of Rs. 87,000/- will be paid in the next two months. The Learned Advocate for the Respondent No.1 acknowledges the receipt of the said amount of Rs. 43,000/-.
In view thereof and for the reasons stated in the Application, the delay is condoned and the Application is allowed in terms of prayer clause (i).
