Judgment
The petitioner is represented by Mr. P.Bora, learned counsel.
The State is represented by Mr. Bidyut Sarma, learned Additional Public Prosecutor.
The case was heard in part on 24-03-2021. The record of the case received from the learned Court below, has been in custody of the Registrar
(Judicial) of this Court, in accordance with the order, dated 24-03-2021.
The learned Additional Public Prosecutor for the State respondent, Mr. N.K. Kalita, was heard in part on 24-03-2021, is not available today before this
Court and the State is represented by Mr. Bidyut Sarma, learned Additional Public Prosecutor.
Mr. Sarma, learned Additional Public Prosecutor, has submitted that one bail application, arising out of the same case, is being heard by another bench
of this Court today. He has also submitted that the connected cases, being BA 399/2021, BA 2801/2020 and BA 2806/2020, arising out of the same
FIR have been fixed for listing on 11-06-2021 before another Bench of this Court.
In fact, Mr. Sarma, learned Additional Public Prosecutor, has requested to direct the registry to list this matter before the co-ordinate bench of this
Court taking up the other connected matters.
On the other hand, as per order No. 19, dated 23-02-2021, all part heard matters, after expiry of one month, would stand released from the respective
Benches and such matters shall be taken up by another Hon'ble Judge, as per roster. This bail application was part-heard by this Court on 24-03-2021
and as such one month period, as mentioned in the above administrative order, is over.
In view of above submission made by Mr. Sarma, learned Additional Public Prosecutor as well as the aforesaid order No. 19, the matter be placed
before the Registrar (Judicial)/Joint Registrar (Judicial) for appropriate steps/action for listing by tomorrow, i.e. on 10-06-2021.
