M.A. 59/2023 is for restoration of the Appeal at Diary No. 521/2023 which was dismissed for reasons of non-compliance with the order of pre-deposit made by this Tribunal on 01.05.2023.
The Ld. Counsel appearing for the Applicant submits that there was one day delay in complying with the order of depositing the 2nd instalment. The 1st instalment was already paid on time. An application for an extension of time is also filed together with this application for restoration.
After having heard the Ld. Counsel appearing for the Appellant. I find that in the interest of justice, the application needs to be allowed. Consequently, M.A. No. 59/2023 is allowed and the Appeal at Diary No. 521/2023 is restored to file. The amount of pre-deposit towards the 2nd and 3rd instalments amounting to ₹ 1 2,50,000/- each is being submitted by way of demand draft today and the same shall be accepted and delay in paying the 2nd instalment is condoned.
Since the entire amount towards the pre-deposit is being paid today, the appeal shall be taken on file if there are no other defects to be cured.
M.A. No. 59/2023 and I.A. No. 330/2023 are disposed of. Post on 08.06.2023 before the Registrar.
