Pramod Deo alias Lallu vs State of U.P.

Applicant-accused Pramod Deo alias Lallu has come to this Court for bail in Case Crime No. 1645 of 2006, u/s 307, I.P.C. Police Station Robertsganj District Sonebhadra.

Heard Sri Ashok Kumar Srivastava, counsel for the applicant and Sri S. D. Trpathi, Addl. Government Advocate for the State.

The accused-applicant resides in the same village i.e., village Saranwan Police Station, Robertsganj.

The complainant Smt. Shanti Devi was married to the uncle of the accused-applicant but whose husband died before consummation of marriage. The complainant claimed the title of the property of the deceased which is said to be opposed by the accused-applicant and this is said to be the motive for the assault.

On the night of 16.11.2006 around 9 O''clock alongwith two other persons, who have also been named in the F.I.R. alongwith the accused, applicant came to the house of the complainant and the accused-applicant is said to have fired upon the complainant in consequence whereof she sustained an injury in her chest.

The medical examination and X-ray report show a bullet embedded in the chest of the complainant. The F.I.R. was lodged within three hours of the incident at the Police Station and Police Station is 15 kms. from the place of occurrence.

The contention from the side of the accused-applicant is that no source of light has been indicated in the F.I.R. That is a matter to be considered at the time of evidence. For the present, we see that there is a prompt F.I.R. and the complainant has a gun shot injury in her chest and the assault was premeditated and planned.

It was also pointed out by the counsel for the applicant that the accused is in jail for last 8 months. Those who, mount murderous assault on defenceless ladies, should be kept confined for longer periods.
