Judgment
The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.128/2018
registered at Police Station Kishangarhbas, District Alwar, for offences under Sections 323, 341 and 307/34 IPC.
Counsel for the petitioner submits that the co-accused Smt. Rani Bai has been released on bail by a co-ordinate Bench of this court vide order
dated 07.05.2018 passed in S.B. Criminal Misc. Bail Application No.5540/2018. Counsel further submits that his case is similar to that of Smt. Rani
Bai W/o Shri Bagga Singh.
Counsel further submits that police after investigation has filed the charge-sheet in this matter before the competent court of jurisdiction and the trial
of the case will take long time.
Learned Public Prosecutor has opposed the bail application.
Considering the submissions made by counsel for the petitioner and also considering the fact that the co-accused Smt. Rani Bai, has already been
released on bail by a co-ordinate Bench, this court deems it just and proper to enlarge the petitioner on bail.
Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Prakash S/o Bagga Singh shall be
enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the
learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
