This matter is taken up through Hybrid Arrangement (Virtual/ Physical Mode).

The petitioner is in receipt of notices vide Annexures-1 and 3 from the Certificate Officer-cum-Sub-Collector, Chatrapur-Opposite Party No.2 for payment of Rs.1,50,000/- (Rupees one lakh fifty thousand).

The grievance of the petitioner is that, the breakup of the certificate dues and the details of certificate dues have not been supplied to the petitioner and he does not know as to why such a certificate dues has been demanded from him. In view of such facts, it is submitted by learned counsel for the petitioner that, the petitioner is not in a position to file show cause under Section 8 of the OPDR Act.

Regard being had to the facts and submissions and the nature of relief sought for, the Certificate Officer-cum-Sub-Collector, Chatrapur-Opposite Party No.2 is directed to supply the breakup and details of certificate dues to the petitioner within a period of three weeks from the date of receipt of the certified copy of this order and the petitioner shall file a show cause within a period of six weeks from the date of receipt of the detail notice with details of breakup from the Sub-Collector-cum-Certificate Officer.

Till disposal of the OPDR proceeding, no coercive action shall be taken against the petitioner.

The writ petition is disposed of accordingly.

Urgent certified copy of this order be granted as per rules.
