Judgment
Rajesh Kumar, J
The applicant No.1, who is in custody since 2018 and applicant No.2 who is in custody since 05.12.2017 have approached this Court for grant of regular bail in connection with S.T. No.109 of 2018 arising out of Kolebira P.S. Case No.14 of 2017 (G.R. No.254 of 2017) registered for the offence under Sections 302 and 201 IPC, pending in the court of Principal Sessions Judge, Simdega.
In pursuance of the order dated 29.03.2023, Mr. A.K. Singh, DGP, Jharkhand is present and has brought I.O. also and it has been submitted that I.O. of the case has already been examined. In fact, all the witnesses have already been examined.
In that view of the matter, this Court finds no reason to entertain present bail application, as all the prosecution witnesses have already examined.
So far as appearance of the DGP, Jharkhand and I.O. of the case is concerned that is dispensed with and order of arrest issued against the I.O. is, hereby, recalled.
The Director General of Police, Jharkhand would be at liberty to proceed departmentally against the concerned Investigation Officer.
With the above observations and directions, this bail application stands disposed of.
