Judgment
This second bail application is filed by the applicant under Section 439 Cr.P.C. The first bail application being S.B. Criminal Misc. Bail Application
No.15002/2019 preferred on behalf of applicant was dismissed by this Court vide order dated 16.12.2019.
Learned counsel appearing for the applicant submits that co-accused, namely, Suresh has already been enlarged on bail vide order dated 31.08.2019
passed by Additional Sessions Judge, Phalodi, District Jodhpur in Bail Application No.330/2019 and, therefore, the applicant also deserves to be
enlarged on bail.
It is noticed that while rejecting bail application preferred on behalf of applicant vide order dated 15.01.2020 passed in Bail Application No.31/2020,
the learned trial court has taken into consideration this aspect of the matter that co-accused has already been enlarged on bail. It is noticed that
number of cases inter-alia for offence under Section 379 IPC are pending against the applicant.
Having regard to the facts and circumstances of the case, this Court is not inclined to enlarge the applicant on bail at this stage.
The second bail application is, therefore, dismissed.
