The jurisdiction of this Court has been invoked under Article 226/227 of Constitution of India with the prayer that this Hon'ble Court may be pleased to issue a writ in the nature of certiorari quashing the illegally terminated order from duty illegally, without notice dated 04.10.1986 passed by respondent No. 2 (General Manager), without considering the facts and evidence on record.
Learned State counsel informs the Court that the case of the petitioner is under active consideration, as per the instructions received from the General Manager, Haryana Roadways, Ambala. He further submits that the petitioner himself may submit a comprehensive written representation to the General Manager, Haryana Roadways, which shall be considered sympathetically in accordance with law, taking into account the principles of equity.
The petitioner may do so within a period of one week from today.
Without adverting to the merits of the case, respondent No. 2 is directed to decide the representation, in case such representation is filed, within a period of eight weeks from the date of its receipt, after providing an opportunity of hearing to the petitioner and by passing a speaking order.
In the light of above, the petition is disposed off.
