CRLMC No.974 of 2024 & I.A. No.475 of 2024
Heard.
Mr. Sharma, learned counsel for the petitioners submits that the issue involved in the present case is similar to the issue pending before this Court in CRLMC No.4036 of 2022 & CRLMC No.1070 of 2022. He further submits that the petitioners are the officials of the M.C.L. against whom the complaint case has been filed for alleged commission of offences under Sections84/85/86 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2023.
Learned counsel for the petitioners further submits that compensation so far as the land is concerned, has already been paid. However, the dispute is regarding non-payment of compensation with regard to structure under Section 9(1) of the Coal Bearing (A & D) Act.
Issue notice to the opposite party by Speed Post/Registered Post with A.D. requisites for which shall be filed within one week.
List this matter on 18th of July, 2024 along with CRLMC No.4036 of 2022 & CRLMC No.1070 of 2022.
In the interregnum, further proceeding in I.C.C. No.161 of 2021 pending in the Court of learned S.D.J.M., Talcher qua the petitioner shall remain stayed till the next date
