Counsel for petitioner submits that admission in B.Sc. (Nursing) Course for the session-2012 is being made on the basis of marks secured in qualifying examination in 10+2 of the Board of Secondary Education, Rajasthan, Ajmer and as per mark sheet of the petitioner he has obtained 376 marks out of 550 but due to some typographical error he indicated maximum marks 600 and marks obtained 334 and only on account of human error committed by the petitioner he was deprived of fair consideration for placement regarding admission of his choice. After notice came to be served, reply was filed by the respondent wherein it has been averred that it was the petitioner''s own mistake for which he has to suffer.
this Court finds substance in the submission made but once admission of the first counselling are made, certainly the students admitted could not be disturbed but this Court at the same time considers it appropriate to observe that this being typographical error as is evident from the mark sheet itself that he has secured 376 marks out of 550 marks, that being so, his candidature still can be considered for admission against the available vacant seats in second counselling as and when held. With these directions/observations, the writ petition stands disposed of.
