Judgment
Vipin Sanghi, CJ
The petitioner has preferred this writ petition to seek the following reliefs:-
“A. Issue a writ, order or direction in the nature of certiorari quashing the order no. 53(1)IV(1)/2020-02(14)/2009 dated 04.02.2020 passed by respondent no. 1, order no.53/IV(1)/2018-02(14)/09 dated 04.02.2020 passed by respondent no. 1 and order no. 53(2)IV(1)/2019-2(14)/2009 dated 04.02.2020 passed by respondent no. 2.
B. Issue a writ, order or direction in the nature of Mandamus directing the respondents to release the retiral benefits, leave encashment, gratuity and arrears of 7th pay commission etc. of the petitioner forthwith.”
The petitioner is a public servant. The reliefs sought by the petitioner squarely fall within the jurisdiction of the Uttarakhand Public Services Tribunal.
Considering the fact that the petition has been pending since the year 2020 and the pleadings have been completed, we direct the Registry to transmit the complete record of the present writ petition to the Tribunal forthwith. The same shall be registered as a Claim Petition and be dealt with by the Tribunal accordingly.
This writ petition stands disposed of.
