Judgment

The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioners, who are in judicial custody in connection with F.I.R. No.293/2022, Police Station Raipur, District Pali registered for the offence punishable under Sections 323, 325 and 308 of the Indian Penal Code.
Learned counsel for the petitioners does not want to press the present bail application for the petitioners No.1 & 2 - Pooran S/o Samada Kathat and Aslam S/o Shakaroo @ Sakoor.
Accordingly, the present bail application moved under Section 439 Cr.P.C. on behalf of the accused-petitioners No.1 & 2 - Pooran S/o Samada Kathat and Aslam S/o Shakaroo @ Sakoor, stands dismissed as not pressed.
So far as petitioner No.3 - Shakaroo @ Sakoor is concerned, learned counsel for the petitioner submits that petitioner No.3 is a 65 years old man and no specific averment has been made against him. Challan of the case has already been presented. The petitioner is in judicial custody and trial of the case will take sufficiently long time. With these submissions, learned counsel for the petitioner prayed that the benefit of bail may be granted to the petitioner No.3.
Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application.
I have considered the arguments advanced before me and gone through the material available on record.
Taking into account the facts and circumstances of the case, without commenting on the merits of the case, this Court deems it just and proper to release the petitioner on bail.
Consequently, the bail application is partly allowed. It is ordered that the petitioner No.3 - Shakaroo @ Sakoor S/o Mithoo Kathat, arrested in connection with F.I.R. No.293/2022, Police Station Raipur, District Pali shall be released on bail provided he furnishes a personal bond of Rs.1,00,000/- with two surety bonds of Rs.50,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
