Judgment

Being aggrieved by order dated 17.4.2021 (Annexure P-1) issued by the Director Dental Health Services, whereby petitioner has been ordered to be transferred from HP Govt. Dental College, Shimla to CH Sunni, District Shimla, petitioner has approached this Court in the instant proceedings for quashing the same.
Having taken note of the fact that the petitioner has already completed her normal tenure of posting at present place, there appears to be no justification to accept the prayer made on behalf of the petitioner.
However, taking note of the fact that the petitioner is nearing superannuation, present petition is disposed of with a direction to the petitioner to make a representation to the concerned respondent requesting for her adjustment at a convenient place, within two weeks from today, which shall be decided within four weeks thereafter, after giving due opportunity of hearing to the petitioner and a speaking order shall be passed thereupon. Subject to the petitioner making a representation within the aforesaid period, she shall not be compelled to join at the transferred place in pursuance to the impugned transfer order dated 17.4.2021 (Annexure P-1).
Petition stands disposed of in the aforesaid terms, alongwith all pending applications.
