The petitioners are seeking anticipatory bail in FIR No.49 dated 15.06.2021, under Section 420 IPC, registered at Police Station Qadian, District Batala.
Learned counsel for the petitioners contends that it is alleged in the FIR that the petitioners had taken money from the complainant for sending him to Dubai and getting a driving licence made for him. He, however, contends that money was allegedly paid by the complainant in cash and the particulars including the date when it was paid are not forthcoming in the FIR. The petitioners are not involved in any other case.
This Court, by the order dated 20.07.2021, had directed the petitioners to appear before the Investigating Officer and join the investigation and in the event of their arrest, they were ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.
Learned counsel for the complainant, however, contends that in view of the serious allegations against the petitioner, he is not entitled to the concession of anticipatory bail.
In view of the above and the petitioners having joined investigation, the order dated 20.07.2021 granting interim bail to the petitioners is made absolute.
However, the petitioners shall abide by the conditions stipulated under Section 438(2) Cr.P.C. They shall also join investigation as and when called upon to do so.
The petition stands disposed of.
