1..In sequel to order passed on previous date, learned counsel for respondent No.1 has submitted that he has instructions to communicate that respondent No.1 is not interested for amicable settlement.
But, at this stage, learned counsel for petitioner submits, as also stated in petition that petitioner is not intending to continue with complaint No. 113-1 of 2018 filed by her, which is pending adjudication in trial Court i.e. Judicial Magistrate 1st Class, Court No.III, Hamirpur, that petitioner, on 26.10.2020, has preferred an application for withdrawal of aforesaid complaint pending before the trial Court. He further submits that petitioner would be contended in case trial Court is directed to proceed further after taking into consideration the application filed by petitioner for withdrawal.
Trial Court has to decide the applications pending before it in accordance with law and for deciding the petition along with applications in accordance with law, none of the parties would have any objection.
Accordingly, petition is disposed of as prayed with direction to the trial Court to proceed further in complaint after taking into consideration the petition as well as applications pending before it and decide the same in accordance with law. Interim order dated 28th October, 2020 stands vacated.
Parties are directed to appear before the trial Court on 19th April, 2021.
Petition is disposed of in aforesaid terms along with pending application(s).
