Leave granted.
We have heard the learned Counsel for the parties.
This appeal is directed against the judgment and order dated 18.2.2009 passed by the High Court of Judicature, Andhra Pradesh at Hyderabad in Writ Appeal No. 161 of 2009.
It is not disputed that civil suits, being O.S. No. 22/2003 & O.S. No. 1/2007 and C.M.A. No. 14/2005 are still pending adjudication.
We, therefore, without making any observation on the merit of the matter, set aside the impugned judgment and remit the matter to the Trial Court for deciding the aforesaid suits without being influenced by any observation made by the High Court in the impugned judgment. It will be open to the parties to raise all contentions including the maintainability of the suit.
Since this matter has been pending before this Court and the High Court for a long time, we request the Trial Court to dispose of these suits as expeditiously as possible.
This appeal is disposed of with the aforementioned observation. The parties are directed to bear their respective costs.
