The original petition is filed to direct the Court of Munsiff-III, Thrissur, to consider and dispose of O.S. No.919/2003 within a time frame.
Pursuant to the order dated 07.10.2022 passed by this Court, the learned III Additional Munsiff, Thrissur, by communication dated 13.10.2022, has informed this Court that the suit is filed for fixation of boundary and recovery of possession. The suit was once listed for trial on 11.12.2018. However, thereafter, the suit was adjourned from time to time and stands posted to 26.11.2022 for completion of steps. The court below would make every endeavour to dispose of the suit within one year.
Heard; Sri.T.M.Abdul Latheef, the learned the counsel appearing for the petitioners and Sri. K.P Sreekumar, the learned counsel appearing for the respondent.
On a consideration of the pleadings and materials on record and after perusing the communication of the learned III Additional Munsiff, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I direct the Court of the III Additional Munsiff, Thrissur, to consider and dispose of O.S.No.919/2003, in accordance with law, as expeditiously as possible, at any rate, within a period of three months after the completion of pre-trial steps.
The original petition is ordered accordingly.
