Judgment
P. Bhavadasan, J.—This is a petition filed u/s 439 of Criminal Procedure Code seeking bail.
Petitioners are accused in Crime No. 79/2009 of Nileswar Police Station for the offences punishable under Sections 3 and 5 of the Explosive Substance Act and Sections 286, 337, 304, and 304(A) Indian Penal Code.
The facts are as stated in the order of the court below, which is appended to this petition. Considering the facts, bail needs to be granted to the petitioners.
The application is allowed as follows:
1) Petitioners shall be released on bail on each of them executing a bond for Rs. 10,000/- (Rupees Ten Thousand only) with two solvent sureties each for the like sum each to the satisfaction of the JFCM concerned.
2) Petitioners shall report before the investigating officer on every Thursday between 10 a.m. and 11 a.m. till final report is laid.
3) Petitioners shall not tamper or attempt to tamper with the evidence or influence or try to influence the witnesses.
