The petitioners / Accused Nos.2 and 3, who apprehend arrest at the hands of the respondent police for the alleged offence under Section 3 (i) of TNPPDL Act in Crime No.308 of 2023, seek anticipatory bail.
The petitioners / Accused Nos.2 and 3, who apprehend arrest at the hands of the respondent police for the alleged offence under Section 3 (i) of TNPPDL Act in Crime No.308 of 2023, seek anticipatory bail.
The allegation against the petitioners is that due to heavy rain, their agricultural lands were submerged and due to which, they damaged the gate of kanmoi and adjusted two stones so as to allow the water to recede. Hence, the Law Enforcing Agency registered a case against the petitioners. The father of the first petitioner was arrested and remanded to judicial custody. The petitioners, who are arrayed as Accused Nos.2 and 3, have filed the present petition for anticipatory bail.
The learned counsel appearing for the petitioners would submit that the petitioners are ready to restore the culvert to its original position. Therefore, he prays this Court to issue suitable direction to the petitioners to reconstruct the culvert as allegedly damaged by them.
In view of the above, the Police officials and other Revenue Officials/authorities are directed to permit the petitioners to restore the kanmoi to its original position with quality materials and file a report after constructing the kanmoi, before this Court.
Post the matter on 23.01.2024 for filing such report.
