Judgment
Learned Senior Counsel for the respondents has handed over the implementation order dated 26.09.2019, vide which interest has been ordered to
be paid to the applicant.
That being so, MA stands satisfied and is accordingly disposed of.
MA 2015/2019
Vide this MA, applicant seeks condonation of delay of 166 days in filing the Review Application.
In view of the averments made in the application, delay of 166 days in filing the Review Application is condoned. MA stands disposed of.
RA 51/2019
Vide this application, the applicant seeks modification of order dated 21.01.2019 under Rule 18 of the Armed Forces Tribunal (Procedure) Rules, 2008
stating therein that the OA was allowed vide order dated 21.01.2019 directing the respondents to revise the gratuity amount on furnishing the
indemnity bond along with interest. However, direction was for refund of Rs. 6 lacs only. It is stated that the sum of Rs. 6 lacs was recovered in one
go and further in eight instalments of Rs. 1,80,000/- each and one instalment of Rs. 15,732/- was also recovered, as such the same is also liable to be
refundable.
Learned Senior Counsel for the respondents has no objection to modification of the order subject to verification.
Under the circumstances, it is directed that further instalments recovered from the applicant as alleged by him be refunded to him after due
verification by the respondents along with interest. This order shall form part of the main order.
RA stands disposed off accordingly.
