The civil revision petition has been filed to set aside the impugned returned order dated 06.02.2024 in the un-numbered execution application filed in E.P.No.3/2019 in O.S.No.250/2005 on the file of the District Munsif Court, Sathyamangalam and direct the District Munsif Court/the Execution Court, Sathyamangalam to number the un-numbered execution application filed in E.P.No.3/2019 in O.S.No.250/2005.

2.The learned counsel appearing for the petitioner submitted that the petitioner is the judgment debtor and the respondent is the decree holder in O.S.No.250 of 2005 on the file of the District Munsif Court, Sathyamangalam. The respondent filed E.P.No.3 of 2019 with the following prayer;

சத்தி ழஃமுஃகொர்ட்ழல் நீதிமன்றத்தார் பிறப்பித்த கால டிகடுவிற்குள் 2. 5 முதல் 7 பிரதிவாதிகள் 1வது சரத்து பழ கிரயம் டிசய்து டிகாடுக்க முன் வராததாலும். 2வது சரத்து பழ சுவாதீனம் டிசய்து டிகாடுக்க முன் வராததால் நீதிமன்றத்தாhர் அவர்கள் 2. 5 முதல் 7 பிரதிவாதிகளுக்கு பழ மனு ஊPஊ ழுசன CPC Order 21 Rule 34 பழ நொட்ழு!; அனுப்பி. நீதிமன்றத்தார் அவர்கள் குறிப்பிடும் தெதிக்குள் வாதிகளுக்கு கிரயம் டிசய்து டிகாடுத்து சுவாதீனம் டிசய்து டிகாடுக்க உத்திரவஜ பிறப்பித்தும். அவ்வாறு டிசய்து டிகாடுக்க தவறியதால் தீர்ப்பாணை 2வது உரூரத்து பழ நீதிமன்றத்தார் அவர்கள் ஊPஊ ழுசனநச CPC Order 21 Rule 35 பழ கூhப்தாவில் கண்ட டிசாத்துக்களை வாதிகளுக்கு கிரயம் டிசய்து டிகாடுக்கவஜம். ஊPஊ ழுசனநச 21 சுரடந 35 பழ கிரய டிசாத்துக்களை வாதிகளுக்கு நீதிமன்றத்தின் மு:லம் சுவாதீனம் டிசய்து டிகாடுக்கும் பழக்கும். தீர்ப்பாணை 3வது உரூரத்து பழ 8வது பத்தியில் கண்ட டிசலவஜ டிதாகை வர வெண்ழயிருப்பதால் சத்தி ழஃமுஃ கொர்ட் ழபாசிட்ழல் உள்ள பாக்கி கிரய டிதாகையில் கூhப்தாவில் கண்ட டிதாகையை ஊPஊ ழுசனநச CPC Order 21 Rule 52 ன் பழ Pro order மு:லம் கூப்தி டிசய்து வசு{ல் டிசய்ய பிராத்திக்கிறார்கள

3.Further, the leaned counsel for the petitioner submitted that he filed an appeal against the judgment and decree passed in O.S.No.250 of 2005. Since there is a delay in filing S.A.S.R.No.141245/2023, to stay all further proceedings in E.P.R.No.3 of 2019 in O.S.No.250 of 2005. The leaned Judge returned the same on 06.02.2024 with the following endorsement;

“Returned on 06.02.2024

1.How this petition is maintainable before this Court

2.Cause title to be correctly mentioned.

3.Petition and affidavit to be stitched.

Hence, returned.

Time 15 days.”

Hence, the civil revision petition has been filed.

4.I have considered the matter in the light of the submission made by the learned counsel for the petitioner and perused the materials available on record.

5.On perusal of the petition returned order, it is noticed that the learned judge returned the petition with endorsement that (i). How the petition is maintainable before this Court, (ii). Cause title to be correctly mentioned and (iii).Petition and affidavit to be stitched and 15 days time is granted. The abovesaid endorsement has been done. Therefore, the learned Judge is hereby directed to receive the stay petition filed by the petitioner and number it if it is otherwise in order and decide it on merit within a week on receipt of the petition filed by the petitioner.

In view of the above, the civil revision petition is allowed with liberty to the petitioner either to file a fresh petition or represent the same.

No costs. Consequently, the connected miscellaneous petition is closed.
