Judgment
Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the Record. With their consent this Criminal Revision Case is disposed of, at the admission stage.
The offences alleged against the accused in Crime No.308 of 2021 pending on the file of Bhadrachalam Town Police Station are under Section 8 (c) r/w.20 (b) of N.D.P.S. Act. The subject vehicle bearing No.AP-16-BG-7777 was seized by the Investigating Officer during the course of investigation. The petitioner herein is claiming to be the owner of the subject vehicle had filed an application before the Superintendent of Police, District Drug Disposal Committee on 11-03-2022.
Now, the grievance of the petitioner herein is that the said committee is not considering the said application and not disposing of the same.
Perusal of the record would reveal that the petitioner herein has sent the said application through registered post and the petitioner has not filed acknowledgement or postal tacking report to show that the same was served on the Superintendent of Police, District Drug Disposal Committee and also the Station House Officer, Badrachalam Town Police Station. The said committee is consisting of 3 members and the petitioner has to submit the petition to the said Committee, which the petitioner has not done.
In view of the same, this Criminal Revision Case is disposed of, granting liberty to the petitioner herein to submit fresh application with the District Drug Disposal Committee, Khammam, in terms of Section 52-A of N.D.P.S. Act and on receipt of the said petition, the Committee is directed to dispose of the same, in accordance with law, within one week thereafter.
Miscellaneous petitions, if any, pending in this Criminal Revision Case, shall stand closed.
