The Habeas Corpus Petition has been filed seeking a direction to the respondents 1 and 2 to produce the detenu Dr.Saravanabalaji, aged about 39 years, who is under the illegal custody of the 3rd respondent, before this Court and set him at liberty.

When the matter was taken up, learned Additional Public Prosecutor appearing for the respondents 1 and 2, on instructions, submitted that the prayer in the Habeas Corpus Petition is not at all maintainable for the reason that the 2nd respondent, namely, the Inspector of Police, T.6 Avadi Police Station, Chennai, during his investigation found that Dr.Saravanabalaji has been taken for treatment by his wife Dr.Sathya Krishnamoorthi, 3rd respondent herein, his parents Mr.Muthukrishnan and Mrs.Malini and his sister Mrs.Indumathi and at present, he is under treatment in Shadithya Hospital, No.7, Tannery Street, Pallavaram, Chennai-43. Learned Additional Public Prosecutor further submitted that the said particulars have been already conveyed to the petitioner herein and he has also acknowledged the same, therefore, the CSR has been closed.

Recording the submission of the learned Additional Public Prosecutor appearing for the respondents 1 and 2, the Habeas Corpus Petition is dismissed as nothing survives for adjudication.
