Judgment

Heard Mr. D. Julius Riamei, learned counsel appearing for the petitioners and Mrs. L. Monomala, learned Government Advocate appearing for the respondents.
The present writ petition has been filed with a prayer for quashing the order dated 08-10-2021 issued by the Deputy Commissioner, Nungba District inviting applications for appointment of Fair Price Shop Agents cum S.K. Oil Sub-Dealers for Nungba Assembly Constituency coupled with a prayer for allowing the petitioners to discharge their functions as Fair Prince Shop Agents cum S.K. Oil Sub-Dealers for Nungba Assembly Constituency till the backlogs are cleared or upto 31-03-2022. On bare perusal of the prayer made by the petitioners in the present writ petition, this court is of the considered view that by efflux of time, the present petition has become infructuous and there is no point in keeping the present petition pending.
In view of the above, the present writ petition is hereby dismissed as infructuous. It is, however, made clear that if the authorities allowed the petitioners to continue to function as Fair Price Shop Agents cum S.K. Oil Sub-Dealers for the Nungba Assembly Constituency in view of the interim order passed by this court on 18-10-2021 and if there is any backlog as submitted by the counsel for the petitioners, they may be allowed to lift such backlogs. This order is subject to the condition that no new agents have been appointed by the authorities before passing of this order.
