Judgment

Heard the parties.
Petitioners have been made accused in connection with Bandgaon P.S. Case No. 29 of 2023 corresponding to Spl. (POCSO) Case No. 01 of 2024 for the offences registered under sections 376/313 of the Indian Penal Code and section 4/6 of POCSO Act, 2012, pending in the court of learned Special Judge POCSO Act, West Singhbhum, Chaibasa.
Between the intervening period of 01.08.2020 to 22.09.2023, the petitioner no. 1 had sexually assaulted the daughter of the informant over a period of time and the petitioner no. 2 had carried out abortion of the prosecutrix.
It was submitted that the statement of the victim has been recorded during the trial in which she has given a complete go-bye to her case and she has been declared hostile.
Photocopy of certified copy of deposition has been filed pointing out that the victim has turned hostile.
Considering the aforesaid facts, petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO Act, West Singhbhum, Chaibasa in connection with Bandgaon P.S. Case No. 29 of 2023 corresponding to Spl. (POCSO) Case No. 01 of 2024.
