K.S. Garewal, J.—The petitioner is Pirthvi Raj. The original allegation of Vikram complainant was that his father Baldev Singh had been threatened by Sunil Kumar, Naresh and Manvar at 4.00 p.m. on January 12,2001. Baldev Singh left house at 6.00 p.m. but did not return at night. Next morning his dead body was found near the petrol pump. The purse and gold ring were missing from the person of Baldev Singh. However, in the F.I.R. Vikram stated that he suspected that his father had been murdered by Sunil, Manvar and Kalu (Naresh) and here the complainant introduced the name of the present petitioner Pirthvi Raj.

The accused were arrested. Gold ring was recovered from Naresh and purse from Sunil Kumar. Evidence agsint the petitioner is that he alongwith Manvar had confessed that they were present when the occurrence took place. They caught hold of Baldev Singh. Thereafter he was hit with brick by Sunil and Naresh alias Kalu. Apart from this extra-judicial confession, there does not seem to be any other prosecution evidence to link Pirthvi Raj petitioner with the crime.

The above circumstances do not warrant further detention of the petitioner is custody.

Bail to the petitioner to the satisfaction of the Chief Judicial Magistrate, Kurukshetra.
