Ld. Counsel for the Financial Creditor present. Ld. Counsel for the Corporate Debtor present.
This application under section 7 has been filed against one entity PK Infrastructure LLP, 770, Marshall House, 25 Strand Road, 7th Floor, Kolkata WB- 700001 and which has been arrayed as the Corporate Debtor. While filing this application reliance has been placed upon the document of NESL at page 145.
Ld. Counsel for the Corporate Debtor pointed out that the Corporate Debtor arrayed in has been wrongly impleaded as the Corporate Debtor. This is clear from page 145 which is a report of the NESL wherein the name of one PK Infraestate LLP has been mentioned. Further on table 2 of page 145, the address is shown to be that of Lucknow, Uttar.
We find from the above record of Corporate Debtor has been wrongly arrayed has the party in this petition therefore this petition is liable to be rejected.
In view of the above facts, this petition is dismissed as not maintainable against the Corporate Debtor named in the petition.
