P.I. Farook vs The District Collector and Others

J. Chelameswar, C.J.—This review application is filed aggrieved by the judgment dated 3rd February, 2011 in W.P.(C) No. 30071 of 2010.

The substance of the review application is that in the guise of the execution of the order of forfeiture of the property belonging to the 5th Respondent under the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act, 1976 the official Respondents are seeking to evict the Petitioner herein from a piece of residential property which undoubtedly was purchased by the predecessor in title of the Petitioner herein from the 5th Respondent. But the Petitioner claims that the property which fell to the share of the Petitioner herein is not the property which was forfeited under the provisions of the above mentioned Act.

The judgment dated 3rd February, 2011 is very categoric that the writ petition was dismissed on the ground that this Court opined that the Petitioner did not approach this Court with clean hands as there was no full disclosure of the material facts.

In the circumstances, irrespective of the truth of the claim made in the review petition, we see no reason to review the judgment under appeal. The review petition is therefore dismissed.
