This public interest litigation (PIL) was about banning or checking the use of plastic. Its indiscriminate use posed a threat to the purity of the environment. Used plastic products less than 120 microns also termed as single-use plastics were most dangerous. Its accumulation, as waste in public places makes the area dirty. Used plastic is very difficult to destroy or recycle. It blocks the drainage system of the area and surrounding region.
By several earlier orders, this Court had directed that the members of the public should be made aware of the dangers of plastic use and be prevented from using plastic of less than 120 microns. We had also directed the authorities to take action so that plastic less than 120 microns could not be brought into this State, manufactured or sold here and to take action against wrongdoers. Furthermore, those products less than 120 microns were to be seized and destroyed.
We are happy to state that the administration had throughout rendered all cooperation to implement our orders.
Lastly, on 14th August, 2025, we had directed an action taken report for East Jaintia Hills district and a supplementary action taken report for East Khasi Hills district to be filed. Such reports have been filed by Mrs Yangi, learned Additional Advocate General.
The writ petitioner, Mr Phuyosa Yobin appearing in person was given an opportunity to peruse the report. He submits before the Court today that he is fully satisfied with the action taken by the State namely, in making the public aware of the bad effects of plastic and taking measures to stop use of single-use plastic less than 120 microns.
We accept the submissions of Mrs Yangi that similar effective action has been taken in other districts. We direct the State administration to continue its awareness programme and its action of stopping the procurement, manufacture, sale and use of plastic less than 120 microns.
The public interest litigation is thus, disposed of with liberty to any person to apply by a fresh application, if and when any breach of the orders of Court occurs.
