Judgment
A.Guneshwar Sharma, J
Heard Mr.H.S.Paonam, learned senior counsel assisted by Mr.N.Bipin, learned counsel for the petitioner and Mr.Th.Sukumar, learned Government Advocate for the State.
The petitioner, being Assistant Engineer in the Water Resource Department, Manipur, is under suspension and facing Disciplinary Proceedings. Disciplinary Proceedings is yet to be completed and he has not been given any copy of the Inquiry Report. Before final order is passed by the Disciplinary Authority, salary of the petitioner has been revised by withholding three increments. Learned senior counsel for the petitioner submits that this is nothing but punishment before completion of the Disciplinary Proceedings and the same is not sustainable in law.
Mr.Sukumar, learned Government Advocate submits that he may be given some time to seek instruction in this regard.
