Perused the material on record.
The Review Application has been filed by the Opposite Party – Dr. R. P. Singh against the Order dated 18.05.2022 of this Commission in Revision Petition No. 3446 of 2016.
The applicant prayed for review on merit and on the clarification about quantum of interest as awarded by this Commission, wherein the Opposite Party (the Review Applicant) was directed to pay Rs. 2 lakh with interest @ 6 % p.a. from the date of filing of the Complaint till realisation.
The applicant submitted that during the proceedings before the State Commission in Appeal, the petitioner (Opposite Party), vide Order dated 11.08.2008, had deposited Rs. 2 lakh on 05.09.2008 before the State Commission. Thereafter, vide Order dated 23.05.2011, the deposited amount was released in favour of the respondent – complainant.
Considering the above averments, in my view, the prayer of the Review applicant appears to be justified and the Order needs clarification on this point. Therefore, the Opposite Party is liable to pay interest up to 05.09.2008 only from the date of filing of the Complaint.
It is further directed that the State Commission shall release the accrued interest, if any, on the deposited amount during the period from 05.09.2008 till the date of its release.
On merit, I do not find any reason to review the Order or re-examine the instant Revision Petition. It is self-contained and self-speaking.
This review application is partly allowed with the above modification.
