Petitioner is aggrieved of the drawing of the stay wires adjacent to the entrance of his property and this fact came to the knowledge when the process of digging was initiated by the respondent electricity board. The photographs Exts.P1 and P2 and the sketch plans Ext.P3 and P4 are the testimony of the same. petitioner had submitted a complaint dated 25.01.2022 to the 3rd respondent Sub Divisional Magistrate. In fact, as per the Licencee Rules it has to be submitted to the KSEB. It is in that background, learned counsel for the KSEB who is present in Court feigns ignorance about the same. Be that as it may. In case the petitioner makes a complaint to the officer of the KSEB, they are enjoined upon an obligation under the Licensees Rules to send it to the ADM for the adjudication of the same.
If the petitioner submits a complaint within a period of one week from today, the concerned KSEB officer will forward the complaint along with their own sketch plan and material in support of digging the land for the purpose of erection of the poles and stay wires to the ADM, who shall take a decision within a period of one month thereafter. Till the decision is so taken by the ADM, digging process near the entrance of the petitioner's property is ordered to be kept in abeyance.
Writ petition is disposed off.
