Prayer in the present writ petition is for releasing the medical reimbursement of the petitioner on account of his treatment of his chronic disease namely Hemiplegia (paralysis of one side of the body) and Carotid Artery Stenosis (narrowing of the large arteries on one side of the neck) from Garg Hospital, Moga, SPS Hospital (Apollo Hospital), Ludhiana and Dayanand Medical College and Hospital, Ludhiana despite the same being found payable as per letter dated 26.10.2017 issued by Civil Surgeon, Moga.
It is contended that the petitioner submitted his bills for reimbursement way back on 15.04.2017 and 08.05.2017. After the receipt of medical bills of the petitioner, District Education Officer i.e. respondent No. 4 sent the same to Civil Surgeon, Moga and the Civil Surgeon, Moga sent the same to respondent No. 6 vide its letter dated 29.03.2018 but respondent No. 6 i.e. Principal, Govt. High School, Karyal, Distt. Moga has not taken any action in this regard inspite of the petitioner removing the deficiencies as pointed out by the Principal. The petitioner was forced to sent a legal notice/demand notice dated 22.10.2019 (Annexure P-13) but no action has been taken.
In view of the above, the present writ petition is disposed of with a direction to respondent Nos. 2, 7 and 8 to decide the legal notice/demand notice dated 22.10.2019 (Annexure P-13) as expeditiously as possible preferably within one month from the receipt of certified copy of this order and in case the petitioner is found entitled, the medical expenses be reimbursed forthwith otherwise a speaking order be passed.
It is clarified that any delay in deciding the same shall incur interest and costs, which will be imposed on the officer responsible for the same.
