Judgment

Heard Mr. T.T. Diengdoh, learned Sr. counsel assisted by Mr. C.C.T. Sangma, learned counsel for the petitioner, who has pressed for admission of this application under Article 227 of the Constitution of India.
The learned Sr. counsel has submitted that the petitioner is essentially aggrieved by an order dated 18.04.2024 passed by the Court of the learned Assistant District Judge, Shillong in Misc C/No. 49 (H) 2023 arising out of T.Ex C/No. 2 (H) 2017, wherein para 6 and 7 of the said order has been pointed out, to say that the Trial Court having issued a decree and execution of the same being duly ordered in course of time, another execution order was passed on the selfsame decree which is impermissible in law. Being thus aggrieved, the petitioner has approached this Court for adjudication of the matter.
Mr. S. Sen, learned counsel has accepted notice on behalf of the sole respondent and has no objection to the admission of this petition. He, however, prays that this matter may be finally heard and disposed of on the next date.
Accordingly, on consideration of the submission made, without going into the details of the merits of this petition, this Court is prima facie satisfied that this petition is fit to be admitted, the same is accordingly admitted.
On consent by the parties, list this matter on 27.05.2025 for hearing.
