Heard learned counsel for the petitioner and learned counsel appearing for the State.

So far as the defect nos. 5(e) is concerned, learned counsel for the petitioner undertakes to remove the same once the situation normalizes. As regards defect no. 8 is concerned, the same is ignored.

The petitioner is an accused in connection with Kuchai P.S. Case No. 26 of 2015 (G.R. Case No. 1132 of 2015 and S.T. Case No. 15 of 2018) registered for the offences punishable under section 302/34 of the Indian Penal Code and section 17 of C.L.A. Act.

The prayer for bail of the petitioner was earlier rejected in B.A. No. 6611 of 2018 with a liberty to the petitioner to renew his prayer for bail if the trial is not concluded within a period of one year.

The allegation reveals that the beheaded body of Mohan Singh Munda was recovered. The petitioner has been implicated on the confession of Kaushalya Kumari @ Sabita. It appears that out of 10 charge sheet witnesses four witnesses have been examined out of whom three have been declared hostile. The informant has been examined as P.W. 3 and he has failed to recognize the petitioner.

Regard being had to the aforesaid facts, the above named petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II at Seraikella, in connection with Kuchai P.S. Case No. 26 of 2015 (G.R. Case No. 1132 of 2015 and S.T. Case No. 15 of 2018).
