A clerk, working with H.P. State Civil Supplies Corporation, who has been transferred after a period of seven years and three months, has come up before this Court seeking quashing of his transfer order as well as order of dismissal of his representation.

Notice. Mr. Mandeep Chandel, Advocate appears and waives service of notice on behalf of respondents No.1 and 2.

It remains undisputed before us that the petitioner had joined in Gas Agency of the respondent-Corporation in the year 2013 at Mehatpur, District Una. On 2.6.2016, the services of the petitioner were regularized. It remains undisputed before us that the petitioner has continued to work in Gas Agency, Mehatpur, District Una w.e.f. March, 2013 till his transfer, vide order dated 6.2.2020, when he was transferred to Whole Sale Godown, Sach (Mandi area). He challenged the said transfer by filing CWP No. 772 of 2020. Vide order dated 29.6.2020, this Court permitted the petitioner to represent the respondents. Thereafter the petitioner filed representation Annexure P-4 dated 30.6.2020, before the first respondent. The first respondent, vide order dated 6.7.2020, rejected the representation of the petitioner with the observation that he has completed seven years at Mehatpur, District Una and never served in tribal area. The Comprehensive Guiding Principles-2013 (Transfer Policy), mention that State Government would make an endeavour that every employee serves tribal/hard areas atleast once. Even otherwise, there is no illegality in the transfer order because the petitioner has completed his normal tenure in the current station.

Given above, there is no merit in the writ petition and the same is accordingly dismissed. Pending application(s), if any, are closed.
