Present petition has been filed under Section 439 of the Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') for grant of bail to the petitioner, in

FIR No.53 dated 07.05.2019, under Sections 420, 467, 468, 471, 120-B of Indian Penal Code, 1860 and Section 13 of Punjab Travelers Protection

Regulation Act, 2012, registered at Police Station Ramdas, District Amritsar.

As per prosecution case, petitioner in connivance with her husband-Paramjit Singh as well as father-in-law-Prabhdyal Singh cheated the complainant

and duped him to the tune of Rs. 18,00,000/- in the month of May, 2018 on the pretext of sending his son to Canada.

It is contended on behalf of the petitioner that she is in custody since 08.05.2019 and after investigation in the matter, report under Section 173 of Cr.

P.C. has already been submitted and nothing incriminating was recovered from her as she married with Paramjit Singh on 10.12.2018 and has no

concern about the alleged transaction.

The factum of custody of the petitioner as well as her marriage with Paramjit Singh is duly acknowledged by learned State counsel, on instructions

from police official present in Court. However, he opposed the bail application while submitting that amount in question was entrusted to the father-in-

law as well as husband of the petitioner.

Heard both sides and perused the paper-book.

There is no dispute that after investigation in the matter, report under Section 173 Cr. P.C. has already been submitted and nothing incriminating was

recovered from the petitioner as she is stated to be married with Paramjit Singh, co-accused in the month of December, 2018, whereas, allegations

pertain to the month of May, 2018. Since charges are yet to be framed, thus, trial will take a long time and her further incarceration would not serve

any useful purpose. Consequently, this Court deems it appropriate to release the petitioner on bail pending trial.

In view of the above, this petition is allowed. Petitioner is ordered to be released on bail, in this case, on her furnishing adequate bail bonds and surety

bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.

The petitioner shall fully co-operate with learned trial Court without seeking any unnecessary adjournments.
