Judgment
The grievance of the petitioner in this case is that the elections are not being held to the Governing Body of Tika Ram Education Society (Regd.), Sonipat, District Sonipat, the sixth respondent.
It appears that the Sub Divisional Magistrate, Sonipat, was appointed as the Administrator of the sixth respondent society, vide order dated 21.09.2018, upon the tenure of the erstwhile Governing Body of the said Society expiring on 22.08.2018.
Perusal of the said order reflects that the Administrator was required to take all necessary steps to hold the elections to the Governing Body of the Society in a time bound manner. The order further reflects that the appointment of the Administrator was for a period of one year or till the conduct of elections to the Governing Body, whichever was earlier. However, the Administrator failed to conduct the elections to the Governing Body and the stipulated period of one year expired. Thereby, the sixth respondent society was left without a controlling authority at its helm. This was the basis for the petitioner's prayer in the present case.
Mr. Rajesh Gaur, learned Additional Advocate General, Haryana, appearing for the respondent authorities, would however inform the Court that the term of the Administrator has now been extended for a further period of one year, that is, upto 30.09.2020 or till conduct of the elections to the Governing Body, whichever is earlier. This order was passed on 19.11.2019 by the Additional Chief Secretary to the Government, Industries & Commerce Department, Government of Haryana. A copy of the said order is placed on record.
In the light of the aforestated development, the grievance of the petitioner stands settled in part, to the extent that the named Administrator would now continue to manage the affairs of the respondent society. However, as a duty was already cast upon the said Administrator to hold elections to the Governing Body of the said society but he failed to do so during his earlier term, necessary steps in that regard shall be taken by him within the time stipulated for holding the elections to the Governing Body of the sixth respondent-society.
The writ petition is disposed of with the above directions.
No order as to costs.
