Judgment
The petitioner has preferred the present writ petition to seek a writ of Habeas Corpus for production of her sister Sulekha. She went missing on
12.09.2020. The suspect is respondent no. 3 â€" Babloo.
Sulekha has been traced and she has been produced before us through a video link. We have interacted with her.
As per the status report, she was born in the year 2000, and therefore, even on the date when she went missing, she was a major. She states that she
went with Babloo of her own free will and accord and that she has married him. To the same effect is her statement recorded under Section 164
Cr.P.C.
Aforesaid being the position, Sulekha is free to reside wherever she wishes and with whosoever she wishes, she being a major.
We, therefore, direct that Sulekha may be permitted to reside with respondent no.3 â€" Babloo. We direct the police authorities to escort her to the
residence of Babloo. The police authorities shall also counsel the petitioner and the parents of Sulekha not to take law into their hands or threaten
either Sulekha or Babloo. The mobile phone number of the Beat Constable of the police station where Sulekha would reside with Babloo should be
provided to both Sulekha and Babloo so that they may get in touch with police officials in case of need.
The petition stands disposed of in the aforesaid terms.
