Judgment

1. The Petitioner applies for regular bail in G.R. Case No.2871 of 2020 corresponding to Jagatpur P. S. Case No.527 of 2020 for the alleged offences under Sections 420, 272, 273 read with Section 34 IPC and Sections 51, 53, 54, 57, 59, 61 and 63 of the Food Safety and Standards Act, 2006 and Sections 36 of the Legal Metrology Act and Rules 32 of the Legal Metrology Act 2011 pending in the Court of learned J.M.F.C. (R), Cuttack.
Admittedly, the co-accused have already been enlarged on bail.
The present Petitioner had earlier approached this Court with BLAPL No.1005 of 2021, which was disposed of by this Court on 11th May, 2021 after noting that the charge-sheet had already been filed and, therefore, the Petitioner should again approach the trial Court. Pursuant thereto, the Petitioner did approach the trial Court, which again dismissed his bail application by an order dated 7th June, 2021.
The Court is not informed of any criminal antecedents of the present Petitioner or his involvement in other cases. Considering that the Petitioner has been in custody since 17th December, 2020, and that the chargesheet has already been filed, the Court considers it appropriate to direct that the Petitioner be enlarged on bail in the aforesaid case during pendency of the trial subject to the satisfaction of the trial Court and subject to the terms and conditions as are deemed fit to be incorporated by the trial Court.
The bail application is disposed of.
